572 BVA & discont 573 & TR Visa

 

A student visa holder who has applied for a subclass 485 visa will receive a Bridging Visa A (BVA) in association with that application. The BVA will not come into effect however, until the Student visa expires. While on a Student visa, holders are expected to maintain
their studies.

If the student does not want to continue studies, the Student visa may be
subject to cancellation. Student visa cancellation in these circumstances
will also cancel the BVA that has been granted in association with the 485
application. This means that the student will only be eligible to apply
for a Bridging Visa E (BVE) while awaiting the outcome of the 485
application.

The work conditions from the Student visa will normally carry over to the
BVE. This means primary applicants would generally be able to work
unlimited hours as their course is out of session. Dependent applicants
however would be restricted to 20 hours of work per week. The work
conditions that apply to the BVE however, would generally be at the
discretion of the decision maker in line with relevant policy and a holder
may apply for conditions to be varied.

Therefore, the options available to this student would be to continue
studying on the Student visa, or request visa cancellation to allow an
application for a BVE. Please note too that a BVE does not permit the
holder to apply for a Bridging Visa B in the event they need to travel
outside Australia and return before the substantive visa application is
decided.
