General Skilled Migration programme

Most General Skilled Migration visas will be assessed against a points test. The pass mark is generally 120 points. In addition you must meet all additional eligibility requirements as required by the relevant legislation. Please contact us for more information.

If you are unable to meet these 5 basic requirements, then you should NOT continue with a General Skilled Migration application.

After going through 1-5 basic requirements and “bonus points”, if you think you meet those requirements then go to theThree step process tab and get familiarised with the three steps.

Processing Priority for Decision Ready Visa Applications -In order to speed up the processing of visa applications, GSM Brisbane (GSMB) has a system whereby we as your lawyers can sign a declaration that we are lodging a complete application (ie, each and every required document has been lodged).

 

This points test is for General Skilled Migration programme. There are other avenues to migrate such as:

 

In this process the time for allocation to a case officer is 10 working days.Please also note that this does not mean that the decision will be made in 10 working days. Once the case officer is allocated the case, the processing time depends on each particular case.This scheme will be used ONLY if the file is absolutely COMPLETE. If any documentation is outstanding this scheme is not applicable.


We are requested by many to make submissions to DIAC and for certification Decision ready and to submit Checklists (DRCs). We undertake this task for client who lodge applications via us and only if the application meets the criteria for Decision Ready. We can only undertake this task from new clients who has all ready lodged the application only if we can verify if the application is a decision ready application and only after we are satisfied that all documents are in order and lodged.

 

1. Age - You must be under 45 when you apply.

2. English language – You must have at least a band score of at least six on each of the four components or a holder of passport from certain English speaking countries. A higher level of English is advantageous, (i.e. a band score of at least seven (7) on each of the four (4) components – speaking, reading, listening and writing of the IELTS (general )Test).

3. Nominated occupation - You MUST nominate an occupation, which fits your skills and qualifications. Your nominated occupation must be in demand in Australia. You cannot apply if your occupation is not in demand in Australia. Please nominate one or more potential occupations from Skilled Occupation List (SOL) – Schedule 3 when submitting your resume to us. 4.Skills assessment –Generally you must have post-secondary qualifications (e.g. university or trade qualification) and you need to obtain a positive skills assessment by the relevant designated Australian assessing authority as being suitable for your nominated occupation.

5. Recent work experience - You must have been employed in an occupation (that there is a demand in Australia) for 12 of the 24 months immediately before lodging your application. More years of work experience will be beneficial to earn extra points.

Exemption – you do not need to meet the work experience requirement if you have completed an Australian qualification less than 6 months before lodging your visa application.

* If you think you meet the above requirements then read below “bonus points” and get familiarised with such.

 

Bonus Points

If you are able satisfy requirements for bonus points it will increase your chances for PR.

* Relatives in Australia - If you or your spouse has an eligible relative living in Australia you will have a greater chance. You, your spouse or your interdependent partner must be related to your sponsor as one of the following:

  • a non-dependent child – including an adoptive or step-child
  • a parent – including adoptive or step–parent
  • a brother or sister – including adoptive or step-siblings
  • a niece or nephew – including adoptive or step–niece or nephew
  • an aunt or uncle – including adoptive or step–aunt or uncle
  • a first cousin - Regional Sponsored
  • a grandchild - Regional Sponsored

* English -You will be awarded extra points depending on your English language ability. (ie, a band score of at least seven (7) on each of the four (4) components – speaking, reading, listening and writing of the IELTS (general )Test).

* Specific work experience -You will be awarded extra points if you have been employed for three (3) of the last four (4) years in an occupation that there is a demand in Australia at a skilled level in your nominated occupation or in a closely related occupation for which there is a demand in Australia.

* Occupation in demand/job offer - If your nominated occupation is on the Migration Occupations in Demand List (MODL) and you have recent work experience related to that occupation, you can be awarded additional points. (Contact us for more information). You will be eligible for a higher number of points if you also have a full time job offer from an employer in Australia.More...

* Community language - To be eligible for points you must be fluent in one of the community languages Australia accepts (e.g. Sinhalese, Tamil, Hindi, Bengali, Urdu, Burmese, Chinese (Cantonese, Mandarin). 'Fluent' means you have professional level skills as evidenced by a qualification (of equivalent standard to an Australian degree) gained from a university where instruction was in one of the listed languages or be accredited as a professional level (translator/interpreter level). * Partner skills - You can claim 'partner skills' points if your spouse or interdependent partner is also able to satisfy the basic requirements of age, English language ability, qualifications, nominated occupation and recent work experience, and if they have obtained suitable skills assessment from the relevant assessing authority.

* Australian work experience -You will be awarded extra points for Australian work experience if you have been employed in Australia lawfully

* Australian qualifications - You can be awarded points for an Australian qualification if:

    • you have completed one of the Australian qualifications ( 2 year study in Australia, a degree with honours ,masters, doctorate) while present in Australia and
    • all instruction was in English.

* Regional Australia study - You can be awarded points if you have met the 2 year study requirement while living and studying in a 'regional Australia/ low population growth metropolitan area' in Australia. Contact us for more information.

 

Secondary applicant eligibility

You may include the following secondary applicants in your visa application:

  • partner
  • a dependent child of you or your partner
  • a dependent relative of you or your partner.

Secondary applicants must meet all of the following requirements:

  • Eligible visa
  • Location
  • English language ability
  • Health
  • Character
  • Australian Values Statement

English requirements for secondary applicants

Secondary applicants aged 18 years or over who do not have functional English must pay a second instalment visa application charge.

This payment will entitle secondary applicants to English language tuition in Australia to enable them to achieve functional English language ability.

Functional English is sufficient English to cope with everyday situations and some work situations.

Applicants who are required to pay this charge will receive information about the Adult Migrant English Program (AMEP) and where they can receive tuition when their visa is granted.

Note: The full amount of this charge must be paid before your visa can be granted.

However, you should not pay this charge until requested to do so by the department.

 

Evidence to attach to your application

To avoid payment of the second instalment visa application charge, you must provide evidence that any secondary applicants 18 years or over included in the application have at least functional English.

This evidence should be provided when requested by the case officer and before the visa is granted.

 

Level of English

Functional

You must provide one of the following:

  • your IELTS TRF Number to show you have a band score of at least four and a half (4.5) based on all four components. 
    Important: If you are using an IELTS test to show functional English, it must be from a test sat no more than 12 months before making your application.
  • evidence that you have a degree, diploma or trade qualification requiring at least two (2) years of full time study or training with all instruction conducted in English
  • evidence that you have completed at least one (1) year of full time study in Australia towards a degree or diploma qualification with all instruction conducted in English
  • evidence that you have completed one of the following at an educational institution where all instruction was conducted in English:
  1. your primary education and at least three (3) years of secondary education, or
  2. at least five (5) years of secondary education.
